$4.5 Million Settlement for a Worker Injured After Falling Through a Covered Floor Opening on Queens Job Site
Supreme Court, Queens County
Accident Description:
Our client, a construction worker, was performing plastering and finishing work at an active construction site in Queens where he had been assigned for several months. As he was leaving work at the end of his shift, he was walking on the first floor of the building when he stepped onto a piece of plywood lying on the floor.
Unbeknownst to him, the plywood was covering an opening in the floor and was not secured in any way. When he stepped on it, the plywood gave way, causing him to fall through the opening and plunge approximately 10 feet into the basement below, striking his face on the edge of the opening as he fell.
Emergency medical services responded to the scene, and our client was transported by ambulance to a nearby hospital, where he was admitted for several days due to the severity of his injuries.
Injury Summary:
As a result of the fall, our client suffered severe facial fractures that required immediate surgical repair, including reconstructive surgery to his facial bones and orbital area. He also suffered injuries to his spine, head, neck, knee, and ankle, ultimately requiring lumbar spine surgery several years later due to ongoing pain and functional limitations. He continues to require medical care and remains unable to return to work as he follows up with his treating physicians.
Settlement Result:
We at Oresky & Associates, PLLC, secured a $4,500,000 settlement on behalf of our client, providing significant compensation for the serious and lasting injuries he suffered as a result of the fall.
