$1.9 Million Settlement for a Worker Injured After Falling from an Unguarded Scaffold in Westchester County, New York
Supreme Court, Queens County
Accident Description:
Our client was working on a residential construction project in Pound Ridge, New York, performing taping work while standing on a metal pipe scaffold. The job required him to work at an elevated height as part of the building’s interior construction. At the time of the incident, the scaffold platform lacked horizontal guardrails or safety railings to prevent a fall.
While performing his assigned duties, our client lost his balance and fell approximately 10 to 15 feet from the scaffold to the ground below. He was not provided with a safety harness, lifeline, rope, or other fall-protection equipment, and he was not required to be tied off while working at height. The absence of basic safety protections directly contributed to the severity of the fall and the injuries he sustained.
Injury Summary:
As a result of the fall, our client suffered severe internal and orthopedic injuries. He sustained multiple broken ribs, a fractured collarbone, and serious internal organ injuries, including a major liver laceration that required emergency treatment and surgical removal of his gallbladder. He also suffered significant injuries to his neck and lower back, including disc damage that caused nerve pain and ongoing physical limitations. In addition, he injured both knees, requiring reconstructive knee surgery, and sustained injuries to both shoulders and hips.
Settlement Result:
We at Oresky & Associates, PLLC, secured a $1,900,000 settlement to address the serious injuries, surgeries, and lasting impact this fall had on our client’s health, livelihood, and future quality of life.
