$4 Million Settlement for a Construction Worker Seriously Injured After Falling from a Lift at a Retail Store in Long Island
Supreme Court, Queens County
Accident Description:
Our client was performing interior renovation work inside a retail store located at an outlet shopping center on Long Island. He was assigned to paint walls and ceilings near built-in cabinets while working from an elevated lift inside the store.
While repositioning himself to reach the area above the cabinets, he stepped from the lift onto the cabinet structure. He lost his balance and fell from an elevated height, landing forcefully into a display area on the store floor. Emergency assistance was called, and he was transported for medical treatment following the fall.
Injury Summary:
As a result of the fall, our client suffered a severe fracture to his left ankle that required surgery to realign and stabilize the bone with metal hardware. He later needed additional surgery to remove the hardware and continues to experience chronic ankle pain, limited mobility, and post-traumatic arthritis that affects his ability to walk normally. He also sustained serious back injuries, including damaged discs in his lower spine, which required spinal surgery and ongoing treatment for pain and nerve symptoms.
Settlement Result:
We at Oresky & Associates, PLLC, obtained a $4,000,000 settlement, holding the responsible parties accountable for unsafe work conditions that led to life-altering injuries.
