$1.25 Million Settlement for a Worker Injured After Falling from a Ladder at a Manhattan Job Site

Supreme Court, New York County

Accident Description:

While working on the 11th floor of a Manhattan building undergoing interior construction, our client was assigned to perform framing work. To complete this task, he was required to use an old, worn, visibly used A-frame ladder, positioned on an uneven work surface.

As our client stood partway up the ladder performing his work, the ladder became unstable and tipped over. The uneven floor and the ladder’s condition caused it to shift to the side, resulting in our client falling to the ground and landing forcefully on his left leg.

Although he initially believed the injury was minor and declined immediate medical attention, he later sought emergency care after realizing the severity of his condition. Medical imaging confirmed a serious ankle fracture caused by the fall.

Injury Summary:

As a result of the ladder fall, our client suffered a severe fracture to his left ankle that required surgical repair with hardware placement, followed by extensive rehabilitation and prolonged non-weight-bearing restrictions. Despite surgery, therapy, injections, and ongoing pain management, he developed chronic regional pain syndrome, persistent ankle pain and instability, and related hip injuries that ultimately required additional procedures. He continues to experience chronic pain, stiffness, and limited mobility, faces early-onset arthritis and the possibility of future surgeries, and remains under medical care while working out of necessity to support his family.

Settlement Result:

We at Oresky & Associates, PLLC, were able to obtain a $1,250,000 settlement on behalf of our client, helping address the lasting impact of his injury and ongoing medical needs.
