$187,500 Settlement for a Boiler Installer Injured in a Bronx Workplace Fall

Supreme Court, Bronx County

Accident Description:

While working as a boiler installer in the basement of a residential building in the Bronx, our client was assigned to install a chain hoist needed to position a new boiler. To perform this task, he needed to reach a beam located near the ceiling of the boiler room.

No ladder, scaffold, or other safety device was provided to allow him to safely reach the beam. As a result, our client was forced to climb onto a piece of boiler equipment to gain elevation. It shifted beneath him, causing him to lose his balance and fall backward to the floor.

Emergency medical assistance was arranged, and our client was transported to a nearby hospital for treatment of the injuries he sustained in the fall.

Injury Summary:

As a result of the fall, our client suffered a serious fracture to his left wrist, including an intra-articular distal radius fracture and damage to the surrounding ligaments and tendons. Despite casting, bracing, medication, and extensive physical therapy, he continued to experience pain, swelling, reduced range of motion, and functional limitations. He was ultimately diagnosed with a permanent loss of use of his wrist.

Settlement Result:

We at Oresky & Associates, PLLC, obtained a $187,500 settlement, holding the responsible parties accountable for failing to provide basic safety equipment.
