$4.25 Million Settlement for Construction Worker Injured in a Tipping Scaffold Accident in Westchester County
Supreme Court, Queens County
Accident Description:
While working at a commercial renovation project in Westchester County, our client was assigned to install a drop ceiling using a rolling Baker’s scaffold. The scaffold was approximately six feet high and had a narrow frame, with a single piece of plywood placed across the top as a work surface.
As our client performed his assigned work from the elevated scaffold, the unit suddenly became unstable and tipped over without warning. He was thrown from the scaffold and fell to the floor below. Emergency medical care was required following the fall, and he was transported for further evaluation and treatment.
Injury Summary:
As a result of the scaffold fall, our client suffered a serious fracture to his right ankle that required emergency surgery, including the placement of an external fixation device followed by additional surgical repair. He also sustained injuries to his lower back and left shoulder, leading to ongoing pain, limited movement, and the need for further treatment, including shoulder surgery and extensive rehabilitation.
Settlement Result:
We at Oresky & Associates, PLLC, secured a $4,250,000 settlement for our client to compensate for his severe injuries, multiple surgeries, and lasting physical limitations.
