$5 Million Settlement for Wrongful Death of a Pedestrian Struck by a School Bus in the Bronx

Accident Description:
The fatal accident occurred at the intersection of Broadway and Moshulu Avenue in the Bronx. On a dark, rainy, and foggy morning, the decedent was lawfully crossing the street when he was struck by a school bus making a right turn onto Broadway. The driver failed to see the pedestrian in the crosswalk and continued moving forward.
As the bus completed the turn, the driver felt resistance and believed he was dragging a vehicle part. Witnesses at a nearby bus stop began screaming and banging on the side of the bus, alerting the driver that a person was trapped underneath. Emergency responders were called to the scene, but the pedestrian suffered fatal injuries. The driver was later found to have violated traffic laws by failing to use due care and failing to yield to a pedestrian in the crosswalk.

As a result of the collision, the pedestrian suffered injuries and became unresponsive at the scene. Emergency responders immediately initiated CPR and life-saving measures, but despite their efforts, he could not be resuscitated. He was pronounced deceased due to traumatic asphyxia caused by severe blunt-force injuries sustained in the impact.
