$5.5 Million Settlement for a Construction Worker Seriously Injured After Falling from an Unfinished Scaffold in Brooklyn

Supreme Court, Kings County

Accident Description:

Our client, a construction worker, was assigned to install a sidewalk bridge and pipe scaffolding around a building as part of an active construction project in Brooklyn. At the time of the incident, he was working on top of an unfinished sidewalk bridge approximately 12 to 15 feet above the ground, assisting in leveling and assembling the scaffold structure.

While performing his assigned duties, our client was caused to walk backwards to check the scaffold’s alignment. There was no available place for him to tie off his safety lanyard, and the bridge contained an unprotected area along its edge. As he stepped back, he tripped on a wooden toeboard at the edge of the bridge and fell backward through the opening to the ground below.

Emergency medical services responded to the scene, and our client was transported by ambulance to a nearby hospital for emergency treatment, where he was admitted due to the severity of his injuries.

Injury Summary:

As a result of the fall, our client suffered serious injuries to his spine, head, shoulder, hip, and knee, including nerve damage that caused weakness, loss of sensation, and difficulty walking, requiring hospitalization and the use of a walker. Despite extensive conservative treatment, he underwent multiple surgeries over several years, including knee reconstruction, cervical spine fusion, hip surgery, shoulder surgery, and ultimately a lumbar laminectomy to relieve ongoing nerve compression.

Settlement Result:

We at Oresky & Associates, PLLC, were able to secure a $5,500,000 pre-trial settlement on behalf of our client, reflecting the severity of his injuries and the lasting impact on his life.
