$725,000 Settlement for a Worker Injured After a Ladder Detached During Penthouse Repairs in Manhattan
Supreme Court, New York County
Accident Description:
The accident occurred at a residential building in Manhattan while our client was performing repair work on the brick façade of a penthouse apartment. The project required workers to regularly move between the main roof and the penthouse roof using an access ladder that was attached to the building.
At the time of the accident, the ladder was not secured to the building and was being held in place only by a rope tied to the penthouse roof. While the rope kept the ladder in a vertical position, it did not prevent the ladder from shifting or coming away from the wall. As Elias Garcia was descending the ladder, it suddenly moved and detached, causing him to fall approximately 10 feet to the lower roof and suffer serious injuries.
Injury Summary:
As a result of the fall, our client suffered a severe and unstable fracture of his right ankle that required multiple surgeries over several years, including surgical repair, hardware removal, and additional procedures to address ongoing instability and joint damage. He was left with chronic ankle pain, limited range of motion, scarring, and post-traumatic arthritis.
Settlement Result:
We at Oresky & Associates, PLLC, obtained a $725,000 settlement to help compensate our client for years of medical treatment, ongoing physical limitations, and the lasting effects of his injuries.
