$7.5 Million Settlement for a Worker Injured After Falling from an Unsecured Scaffold During Internal Demolition Work in Brooklyn

Supreme Court, Kings County

Accident Description:

Our client was performing interior demolition work as part of a major renovation project at a multi-story building in Brooklyn. At the time of the incident, he was working on the fourth floor while standing on an unsecured metal pipe scaffold approximately eight feet high. The scaffold platform consisted of wooden planks and was not equipped with guardrails, safety netting, or any fall-protection system.

While our client was using a crowbar to remove sections of the ceiling, a large and heavy piece of concrete suddenly broke free and fell from above. The falling concrete struck both the scaffold and our client, causing the wooden planks beneath his feet to snap and the scaffold to tip over. With no safety equipment in place and nothing to grab onto, our client was thrown to the floor below and suffered serious injuries as a result of the fall.

Injury Summary:

As a result of the scaffold accident, our client suffered severe injuries to his neck and spine, including significant disc damage that caused nerve compression and weakness in his arms. He required major cervical spine surgery to relieve pressure on the spinal cord and stabilize his neck. He also sustained serious lower back injuries that later required lumbar spine surgery, along with chronic pain that radiates into his legs.

In addition, our client suffered serious injuries to his left knee and left shoulder, including ligament tears and joint damage that required surgical intervention.

Settlement Result:

We at Oresky & Associates, PLLC, were able to achieve a $7,500,000 recovery to compensate our client for the life-altering injuries, chronic pain, and ongoing limitations caused by unsafe demolition conditions.
