Accident Description:
Our client, a 70-year-old woman, was Christmas shopping with her family at a large shopping mall in Brooklyn when the accident occurred. After exiting a store, she needed to reach the elevator leading to the parking level, which was located a considerable distance from the store entrance. She felt tired and couldn’t walk any farther, so she sat on the seat of her walker while her daughter helped by pushing her forward.
As our client was being pushed toward the elevator, the walker traveled a substantial distance without incident. The fall occurred only when one of the front wheels struck a raised concrete tile in the walkway near the elevator, causing the walker to come to an abrupt stop and tip forward, throwing her to the ground.
The incident was captured on the defendant’s security surveillance footage, which clearly confirmed that the raised tile was the cause of the fall. Emergency medical services responded to the scene, and our client was transported by ambulance to a nearby hospital for evaluation and treatment of her injuries.
