Under the New York Estates, Powers and Trusts Law (EPTL), survivors are entitled to “fair and just compensation for pecuniary injuries”.

How Long Do I Have to File a Wrongful Death Lawsuit in New York?
The statute of limitations in most wrongful death cases is two years in the state of New York. In other words, the executor has two years from the date of death to file a lawsuit. If the deceased person was a victim of medical malpractice, the personal representative must file a lawsuit within two years and six months from the date of death.
However, if the responsible party is facing criminal charges, you’ll have one year from the date the criminal charges are resolved to file a wrongful death lawsuit.
These deadlines are crucial. If the personal representative doesn’t file a lawsuit before the statute of limitations expires, your family will lose your right to compensation.
