Car Accident Legislation in the Bronx: Hit-and-Run Laws
Several laws and regulations may affect your hit and run case. Here are just some of the laws that are relevant to these accidents in the Bronx:
Statute of Limitations
State laws determine how long you have to file for damages after a hit-and-run accident. Our lawyers can tell you how long you have to take legal action, and if any circumstances impact this deadline.
Insurance Requirements
New York State requires drivers to obtain PIP insurance, liability insurance, and uninsured motorist coverage for bodily injury. After your accident, our lawyers can help you pursue damages through your PIP and uninsured motorist policies. If possible, we will also pursue damages from the at-fault driver via a liability claim once found.
Whether you were in an uninsured vehicle at the time of the accident, hurt while walking or biking, or covered by a family member’s policy, we will make sure we seek full compensation through available policies.
Who Can Be Held Liable for a Hit-and-Run Car Accident in the Bronx?
At Oresky & Associates, PLLC, we will attempt to identify the liable parties and pursue them for all the damages you deserve. Typically, the following parties are the ones liable for hit-and-run accidents.
The Fleeing Driver
If we are able to locate the driver who fled the scene of the accident, we may be able to pursue damages from this party.
The Vehicle Owner
If the driver of the hit-and-run vehicle was not the vehicle’s owner, then we can pursue damages against both the driver and the person who lent their car to the irresponsible driver.
What Damages Can I Recover as a Hit-and-Run Crash Victim?
First, our firm will help navigate your no-fault insurance and uninsured motorist policies. No-fault insurance provides limited compensation for losses such as:
- Medical treatment expenses
- A portion of lost income
- Injury-related expenses
You may be able to seek damages through an uninsured motorists claim. We can seek damages for economic and non-economic losses.
This claim may be filed through your own automobile insurance policy, host vehicle’s insurance policy, or through the insurance policy of a family member. Your recovery will be limited by the insurance policy’s limits. If there is no applicable insurance policy you may file through MVAIC if you are eligible.
Our hit-and-run team will make sure to explore all possible avenues of compensation to get you the money you need. These include uninsured motorist coverage and Motor Vehicle Accident Indemnification Corporation (MVAIC) coverage.
Can I Recover Damages If I’m Being Partially Blamed for a Hit-and-Run Accident in the Bronx?
